Terms of Service

1. Acceptance of Terms

By accessing or using CardSpotter ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time by posting the revised version on this page with an updated date. Continued use after changes constitutes acceptance.

2. Description of Service

CardSpotter is a collectible card discovery platform that aggregates eBay listings, provides search and filtering tools, pricing calculators, community listings, and seller profile features. The Service includes both free features and paid subscription tiers.

3. Accounts

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate information and promptly update it if it changes. We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions and Billing

Paid Plans: CardSpotter offers a Seller subscription plan at $9.99/month. Subscriptions are billed monthly and automatically renew at the end of each billing period unless canceled.

Payment Processing: All payments are processed securely through Stripe. CardSpotter does not store your credit card information.

Auto-Renewal: Your subscription will automatically renew each month. You will be charged the then-current subscription fee unless you cancel before the renewal date.

Cancellation: You may cancel your subscription at any time through your account dashboard or by contacting support. Upon cancellation, your subscription remains active through the end of the current billing period. No partial refunds are provided for unused time within a billing period.

Price Changes: We may adjust subscription pricing with at least 30 days notice. Price changes take effect at the start of your next billing cycle after the notice period.

5. Seller Features

Paid subscribers may link their eBay Seller ID to import up to 50 active eBay listings daily into the CardSpotter platform. CardSpotter displays these listings to help drive visibility but does not guarantee any specific sales outcomes, traffic levels, or conversion rates.

You represent that you are the authorized owner of any eBay seller account you link and that your eBay listings comply with all applicable eBay policies and laws.

6. Affiliate Links and Third-Party Content

CardSpotter contains affiliate links to eBay and other third-party marketplaces. We may earn commissions from qualifying purchases made through these links at no extra cost to you. We are not responsible for the accuracy, availability, or condition of third-party listings, products, or services. All purchases are governed by the terms of the respective marketplace.

7. No Investment Advice

CardSpotter provides market data, pricing tools, and listing aggregation for informational purposes only. Nothing on this platform constitutes investment, financial, or purchasing advice. Card values fluctuate and past prices do not guarantee future results. You are solely responsible for evaluating listings and making purchasing decisions independently.

8. Intellectual Property

The CardSpotter name, logo, website design, and original content are the property of CardSpotter. You may not reproduce, distribute, or create derivative works from our content without prior written consent. Listing data displayed on CardSpotter is sourced from eBay and respective marketplaces and remains the property of those platforms.

9. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Scrape, crawl, or use automated means to access the Service without permission
  • Interfere with or disrupt the integrity or performance of the Service
  • Impersonate another person or entity or misrepresent your eBay seller identity
  • Use the Service to manipulate or deceive marketplace buyers

10. Limitation of Liability

To the maximum extent permitted by law, CardSpotter and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount you paid to CardSpotter in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that listing data will be accurate or complete.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, and disclaimers survive termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or the Service shall be resolved in accordance with applicable state and federal law.
